STATEMENT | SAFE Applauds Bipartisan Senate Agreement on Permitting Reform

The Bipartisan American Affordability Act of 2026 would address the cycle of endless litigation stalling essential energy, minerals, and grid security projects

Washington, DC—Responding to today’s release of the Bipartisan American Affordability Act of 2026 by Senators Shelley Moore Capito (R-WV), Mike Lee (R-UT),  Sheldon Whitehouse (D-RI), and Martin Heinrich (D-NM), Avery Ash, CEO of SAFE, released the following statement:

“For too long, the projects our economy and national defense depend on—ranging from mines and processing facilities to power generation and transmission lines—have been trapped in years of outdated process and unending litigation. This bipartisan agreement takes the principled approach an all-of-the-above energy strategy demands: Rules for building should be clear, predictable, and the same whether a project supports traditional energy, advanced energy technologies, or the infrastructure that connects them. We commend Senators Capito, Lee, Whitehouse, and Heinrich for doing the hard work of bipartisan compromise, and we urge their colleagues to move this bill forward,” said Ash.

“Every year that a domestic mine or a new transmission line sits in court is another year America stays dependent on supply chains controlled by a strategic competitor. Speed to build is strategic capacity. Bringing certainty to the review process, while preserving meaningful public input, is how we close that gap.”
